Car accident in Spain: How do I behave correctly?

Fill in the accident report.

This is the most important evidence in the event of a different version of the accident. It is also advisable to take photos of the vehicles and note down witnesses (who should not belong to the vehicles involved in the accident). Important here: place, date and time of the accident; state if there are any casualties, even if they are slightly injured; names of witnesses, insured parties and drivers; make, model and registration number of the vehicle; details of car insurance; details of damage to the vehicle

Is it necessary to call the police?

If you and the other party fill out the report and are in agreement, it is not necessary. If you see a conflict, it would be advisable.

Remember that it is illegal to tow a vehicle in Spain.

Call the breakdown service, which is normally included in your insurance policy.

Do not hesitate to report the incident to your insurance company!

In Spain, it is your own company that will deal with the matter. If you are innocent, your insurance company will claim the damage from the other insurance company.

Never repair a vehicle without first having the damage checked by an expert from the insurance company!

What can you claim in the event of a car accident?

The cost of repairing the vehicle, daily compensation for the days you were absent from work and/or undergoing medical treatment, as well as compensation for the permanent consequences.

Are you entitled to a courtesy car if you are not at fault for the accident?

Unfortunately, it is very difficult to get a replacement vehicle in Spain. It depends on the availability of the repair shop and you will have to pay any costs incurred, regardless of the cause of the damage.

Can your vehicle be repaired at any garage?

You should check your insurance contract here. Normally, you have a free choice of garage, but there are exceptions depending on the policy. If in doubt, please contact us.
